(1) Save as provided in sub-section (2), no person released from prison on the expiration of a sentence of imprisonment or on parole shall be disqualified or discriminated against on grounds of his having been detained in prison, in the matter of employment under the State Government or any undertaking owned or controlled, wholly or partly, by the State Government or any private employer. (2) The State Government may, by notification in the Official Gazette, direct that persons having been detained in prison on conviction for such offence or class of offences shall be deemed to be ineligible for such kind or kinds of employment under the State Government or any undertaking owned or controlled, wholly or partly, by the State Government, as may be specified in such notification: Provided that the State Government may, on merit of individual cases, by order, exempt such a person from the operation of such notification.
