If any raiyat recovers from an under-raiyat rent in excess of the amount due Refund of rent under this Act, he shall forthwith refund the excess amount so recovered and recovered in excess. shall also be liable to punishment as provided in this Act. Commutation of rent payable in kind 1[116A. "Notwithstanding anything contained in any contract, an under-raiyat may pay the rent to the competent authority in the prescribed manner on the raiyat's refusal to accept the rent offered to him and shall on such payment get valid discharge of his liability to pay the rent to the raiyat who shall be paid the rent or market value thereof in the case of rent in kind, by such authority after deducting such recovery charges as may be prescribed".
