THE ASSAM GAZETTE, EXTRAORDINARY, AUGUST 4, 1976 ASSAM ACT XI OF 1976 (Received the assent of the President of India on 22nd July, 1976) THE ASSAM RURAL INDEBTEDNESS RELIEF (AMENDMENT) ACT, 1976. An Act to amend the Assam Rural Indebtedness Relief Act, 1975. Preamble. Whereas it is expedient to amend the Assam Act. Assam Rural Indebtedness Relief Act, 1975, XII of 1975. hereinafter called the principal Act, in the manner hereinafter appearing ;

It is hereby enacted in the twenty-seventh year of the Republic of India as follows :- Short title, extent and 1. (i) This Act may be called the Assam commencement. Rural Indebtedness Relief (Amendment) Act, 1976. (ii) It shall have like extent as the principal Act. iaCode (iii) It shall come into force with effect from the 6th day of February, 1976. Amendment 2. In Section 2 of the principal Act, at the of Section 2 end of clause (f), the following shall be added, of Assam namely :- Act XJI of 1975. "and includes a person who follows any one or more of the following agricultural occupations in the capacity of a labourer on hire or exchange, whether paid in cash or in kind or partly in cash and partly in kind :- (i) farming including cultivation . and tillage of soil, etc. ; (ii) dairy farming ;

(iii) production, cultivation, growing and harvesting of any horticultural commodity ; (iv) raising of livestock, bees or poultry : and THE ASSAM GAZETTE, EXTRAORDINARY, AUGUST 4, 1976 (v) any practice performed on a farm as incidental to or in conjunction with farm operation (including any forestry or timbering operations) and preparation for market and delivery to storage or to market or to carriage, for transportation of farm products. Amendment 3. In sub-section (2) Section 6 of the of Section 6 of principal Act the words "within a period of Assam Act 45 days from the date on which this Act XII of 1975.comes into force put back the debtor in possession of the land" occurring after the word "shall" be substituted by the words "if demanded by the debtor before the expiry of 5 years or on expiry of 5 years from the date on which the debt was incurred, put back the debtor in possession of the land within a period of 30 days from the date of demand or expiry of 5 years as the case may be." Amendment 4.

Sub-section (3) of Section 9 of the of Section 9 of principal Act shall be substituted by the Assam Act following :---- XII of 1975. "When a transaction is held to be a mortgage under sub-section (1) of Section 9 above, provisions of sub-sections (1) and (2) of Section 6 shall be applicable to such mortgage." Amendment 5. (1) In Section 10 of the principal Act, in of Section 10 sub-section (1) for the figures and words of Assam Act". XII of 1975. "3 years" and "90 days" the figures and words 5 years" and "1 year" respectively shall be substituted. (2) In sub-section (2), for the figure and word "90 days" the figure and word "1 year" shall be substituted.
