[Received the assent of the Governor on the 28th March. 1999; assent first published in the "Madhya Pradesh Gazette (Extraordinary)", dated the 29th March, 1999.] An Act to amend the Madhya Pradesh Zila Yojana Samiti Adhiniyam, 1995. Be it enacted by the Madhya Pradesh Legislature in the Fiftieth Year of the Republic of India as follows :- Short title. 1. This - Act may be called the Madhya Pradesh Zila Yojana Samiti (Sanshodhan) Adhiniyam, 1999. Amendment of long title. 2. For the existing long title of the Madhya Pradesh Zila Yojana Samiti Adhiniyam, 1995 (No. 19 of 1995) (hereinafter referred to as the Principal Act), the following long title shall be substituted, namely :- "An Act to constitute District Planning Committee for the purposes of Article 243-ZD of the Constitution of India and to discharge the functions of the State 380 (1) Government in regard to the items of business of the Government and for matters ancillary thereto.".

3. For sub-section (1) of Section 3 of the Principal Act, the following sub-section shall Amendment of be substituted, namely :- Section 3. "(1) There shall be constituted in each district a District Planning Committee, to consolidate the plans prepared by the Panchayats and Municipalities in the' district and to prepare a draft development plan for the district as a whole and to exercise such other powers as may be entrusted to it by the State Government from time to time.'l. 4. BE it enacted by the Madhya Pradesh Legislature in the Fiftieth Year of the Republic of India as follows :--. Short Title and commencement. Adhiniyam, 1999, 1. (1) This. Act may be called the Madhya Pradesh Zila Yojana Samiti (Dwitiya Sanshodhan) C. (2) It shall come into force on such date as the State Government may, by notification, appoint and different dates may be appointed for different provision of this Act. Amendment of Section 2. 2. In Seetion 2 of the Madhya Pradesh Zila Yojana Samiti Adhiniyam, 1995 (No. 19 of 1995) (hereinafter referred to as the Principal Act), for clause (b), the following clause shall be substituted, namely :- "(b) 'District' means a district as construed in the Madhya Pradesh Land Revenue Code, 1959 (No.

20 of 1959) and includes one or more such revenue districts, or parts thereof, as are comprised within the Zila Panchayat constituted for the district.". Amendment of Section 3. 3. In Section 3 of the Principal Act,- (i) in sub-section (1), for the words "in each district", the words "for a revenue district or a group of revenue districts and parts thereof with a common Zila Panchayat" shall be substituted ; (ii) after sub-section (2), the following sub-section shall be inserted, namely :- "(3) Where the term of the existing members of the Municipality/Zila Panchayat has expired and the elected members cease to be members of the committee then the committee with remaining members shall continue to discharge the functions till new elections are held.". 4. For Section 4 of the Principal Act, the following section shall be substituted, namely :- "4.

(1) The Committee shall consist of 10, 15 or 20 members in different districts, as specified in the Schedule. (2) (i) Four-fifths of the total number of members of the Committee shall be elected in the Prescribed manner by and from amongst the elected members of the Zila Panchayat and of the Municipalities in the district or group of revenue districts, as the case may be. (ii) The number of members to be elected from the rural and urban areas shall be as nearly as is possible, in proportion to the ratio between the population of the rural and urban areas of the district or group of revenue districts, as the case may be. Substitution of new Section for Section 4. Composition of Committees. (3) e remaining members of the committee shall be- (a) a Minister of the State of Madhya Pradesh to be nominated by the State Government, who shall be the Chairperson of the Committee;

(b) the District Collector who shall be the Member-Secretary; (c) where the number of members of the committee, as specified in the schedule is- (i) fifteen one member; or (ii) twenty two members to be nominated by the State Government: Provided that the Collector of the district which describes the Zila Panchayat shall be the Member-Secretary of the District Planning Committee. (4) The members nominated under clause (c) of sub-section (3) shall hold office for such term as may be notified by the State Government. 5. After sub-section (2) of Section 5 of the Principal Act, the following sub-section shall be _Amendment of ted, namely :- Section 5. "(3) The President of the Zila Panchayat and the Mayor of the Municipal Corporation in the district shall also be permanent special invitees, in case they are not elected Members of the Committee.".

Be it enacted by the Chhattisgarh Legislature in the fifty second year of the Republic of India as follows :- Short title extent and commencement. 1. (1) This Act may be called the Chhattisgarh Zila Yojana Samiti (Sansodhan) Adhiniyam,2001 (No.

21 of 2001). (2) It extends to the whole of Chhattisgarh. (3) It shall come into force on such date as the State Government may, by notification, appoint. Amendment of long title. 2. Whereas it is expedient to amend the Chhattisgarh Zila Yojana Samiti Adhiniyam, 1995; AND WHEREAS the State Legislature is not in session, and the Governor of CHATTISGARH is satisfied that circumstances exit which render it necessary for him to take immediate action :- NOW THEREFORE, in exercise of the powers conferred by clause (1) of Article 213 of the Constitution of India, the Governor of Chhattisgarh is pleased to promulgate the following ordenance :- Short title, extent and commencement. (1) This Ordinance may be called the Chhattisgarh Zila Yojna Samiti Adhiniyam (Sanshodhan Adhyadesh, 2001. (2) It extends to the whole of Chhattisgarh.
