Preamble

THE COINAGE ACT, 2011

ACT NO. 11 OF 2011

[1st September, 2011.] An Act to consolidate the laws relating to coinage and the Mints, the protection of coinage and to provide for the prohibition of melting or destruction of coins and prohibit the making or the possession thereof for issue and for matters connected therewith or incidental thereto.

BE it enacted by Parliament in the Sixty-second Year of the Republic of India as follows:--

Key Provisions

Definitions

• Coin: Encompasses any coin made of metal or other material stamped by the Government, including legal tender, commemorative coins, and notably, the Government of India one rupee note, with exclusions for credit and debit cards.

• Deface: Defined as the alteration of a coin's surface or shape that is distinguishable from reasonable wear.

• Mint: Refers to the Security Printing and Minting Corporation of India Limited or any other organisation authorised by the Government.

Coinage Provisions

• Specifications and Legal Tender:

• Denominations, Dimensions, Designs, and Composition: Prescribed by the Government.

• Legal Tender: Specifies the maximum sums for which different coin denominations are legally acceptable.

• Decimal System: Mandates the rupee to be divided into 100 units.

Offences and Penalties

• Prohibited Activities:

• Making, melting, destruction, or unlawful possession of coins.

• Penalties:

• Up to 7 years imprisonment and a fine for melting, destruction, or unlawful possession.

• Penalties for other prohibited activities, including making or bringing in unauthorized metal pieces for use as money.

Regulatory and Protective Provisions

• Rule Making Power: The Government is empowered to make rules to carry out the Act's purposes.

• Good Faith Protection: Shields persons acting in good faith under the Act from legal proceedings.

• Repeal and Savings: Repeals preceding enactments while preserving existing rights and proceedings.
