What this Act covers

Summary of Explosives Substances Act, 1908

Integrated Scope and Definitions

• Expansive Application: The Explosives Act, 1908, as amended, applies broadly across India, with international treaty implications (e.g., Chemical Weapons Convention Act, 2000).

• Definitions: Encompass "explosive," "manufacture," "licence," and by implication from newer acts, "Toxic Chemicals," "Precursors," and "Chemical Weapons" for a more contemporary understanding.

Regulatory and Enforcement Evolution

• Central Government Enhanced Powers:

• Prohibition and Regulation: Of especially dangerous explosives and, by extension, chemical weapons under the Chemical Weapons Convention Act.

• International Compliance: Through notifications and adherence to global treaties (e.g., prohibition of chemical weapons development, production, and use).

• Licensing Authority with Broader Considerations:

• Grant of Licences: Now implicitly considering national security, public safety, and compliance with international treaties.

• Refusal of Licences: Expanded to include reasons related to chemical weapons, national security, and public safety concerns.
