KARNATAKA ACT NO. 42 OF 2020 THE KARNATAKA STATE CIVIL SERVICE (REGULATION OF TRANSFER OF STAFF OF DEPARTMENT OF TECHNICAL EDUCATION) (REPEAL) ACT, 2020 Arrangement of Sections Sections: 1. Short title and commencement 2. Repeal and savings 3. Repeal of Karnataka Ordinance No. 20 of 2020 and savings STATEMENT OF OBJECTS AND REASONS ACT 42 OF 2020 .- It is considered necessary to repeal the Karnataka State Civil Services (Regulation of transfer of staff of Department of Technical Education) Act, 2012 (Karnataka Act 12 of 2013) to remove the difficulties and hurdles occurred in implementation of the said Act and it is decided to frame rules in this regard under the Karnataka State Civil Services Act, 1978 (Karnataka Act 14 of 1990). As the matter was urgent and both Houses of the State Legislature were not in a session, The Karnataka State Civil Services (Regulation of transfer of staff of Department of Technical Education) Ordinance, 2020 (Karnataka Ordinance 20 of 2020) was promulgated to achieve the above object. This Bill seeks to replace the said Ordinance. Hence, the Bill. [L.A. Be it enacted by the Karnataka State Legislature in the seventy-first year of the Republic of India as follows :- Code 1. Short title and commencement .- (1) This Act may be called the Karnataka State Civil Services (Regulation of transfer of staff of Department of Technical Education) (Repeal) Act, 2020. (2) It shall be deemed to have come into force with effect from 28.08.2020. 2. Repeal and savings .- The Karnataka State Civil Services (Regulation of transfer of staff of Department of Technical Education) Act, 2012 (Karnataka Act 12 of 2013) (hereinafter referred to as the principal Act) is hereby repealed: Provided that, such repeal shall not affect,- (a) the previous operation of the Act so repealed or anything duly done or suffered thereunder; or (b) any right, privilege, obligation or liability acquired, accrued or incurred under the Act, so repealed;
or (c) any penalty, forfeiture, or punishment incurred in respect of any offence committed under the Act so repealed; or (d) any investigation, legal proceeding, or remedy in respect of any such right, privilege, obligation, liability, penalty, forfeiture or punishment as aforesaid; and any such investigation, legal proceedings or remedy may be instituted, continued or enforced and any such penalty, forfeiture and punishment may be imposed, as if this Act had not been passed. 3. Repeal of Karnataka Ordinance No. 20 of 2020 and savings .- (1) The Karnataka State Civil Services (Regulation of transfer of staff of Department of Technical Education) Ordinance, 2020 (Karnataka Ordinance 20 of 2020) is hereby repealed. (2) Notwithstanding such repeal, anything done or any action taken under the principal Act, as amended by the said Ordinance, shall be deemed to have been done or taken under the principal Act, as amended by this Act.
