NOTMCATION

Mizoram have authorized t}te Central Govemmenq *mugh a Regulatory Corunission for States ofMaaipur and Mizoram and to frame rulps to carry out the Provisiom ofthe El€ctric ity Act.2003 relatingto the Joint Cornmission;

And whereas thc Central Covernmelt vide Notification No. S.o.62(E), dated l8thJanuary,2005 has constitutcd the Joint Electricity Regulatory Commission for Manipur and Mizoram:

Now, therafore, in exercise ofpowers conferred by Secdon 105 and clause (i) ofsub-section (2) ofSection 180 ofthe Electricity Act, 2003 (No. 36 of2003), thc Central Covemnr,ent hereby makes the following rules, namely l- . l. Short tltle atrd commencement.{ I ) These rules may be called the Joint Electricity Regulatory Commission for Manipur and Mizoram (Preparation of Ann,.ral Report; Rules. 20 I 0.

(2) They shall come inlb force on the date oftheil . publication in the Oriicial Gazette.

. 2. Dcfinitions.-( I ) ln these rules, unless the context otherwise requires,- (a)'Act' means the Electricity Act, 2003;

O)'Joint Commissioir' meansthe Joint Electricity Regulatory Commission for Manipur and Mizoram, constituted under Section 83 ofthe Acu (c)' Particiiating State' means the State of Manipur or the State of Mizoram;

(d) 'schedule' means the schedule annexed to . lhese rules.

(2) Words ald expressions used and not defued in these rules but defined in the Elecriciry Ac! 2003, shall have the meaningd respectively assigred to them in that Act.

the Joint Commission shall prepare an Annual. Repon containing a summary ofits activities during the previous year commencing from the I siday of April to the 3 I st day of March ofthe following year in tie form specified in the Schedule.

(2) The Annual Repon shall giyc an account ofthe activities during the previous financial year,- containing, .inter-alia,-

(a) a stalement ofgoals and objectives ofthe Joint Commisssion;

O) annual largets set for various activitics in the background ofclause (a) together with a brief review ofactual performance with reference to those targets and including in particular a repon on lhe number of cases filed before the Joint Cornmission during the ycar, number ofcases disposed of, time taken to dispose ofthe cases ' and number ofcases pending;

(c) imponant additions/changes in the regulations of the Joint Commission;

(d) functioning of the State Advisory Committee and other consultation with the stak€holders;

(e) trends ofimportant paramcteB such as capitrl cost, cost of electricity, new investment, efEciency gains;

(0 number and details of cascs in which orders/ regulatious ofthe Commission were challenged . in Couns/Appellale Tribunal and thc outcome of such cases; and

(g) resolution of disputes including the disputes pending at the end ofthe ycar.

4. Submission of An nusl Report.-The copics of the annual report shall be forwarded by the Joint Commission to the Central Government and the Panicipating State Covemments by the end of October each year.
