West Bengal Act XX of 1974

THE HOOGHLY RIVER BRIDGE (AMENDMENT) ACT,

[Passed by the West Bengal Legislature.] [Assent of the President was first published in the Calcutta Gazette, Extraordinary, of the 4th April, 1974.] [4th April, 1974.] An Act to amend the Hooghly River Bridge Act, 1969.

WHEREAS it is expedient to amend the Hooghly River Bridge Act, 1969, for the purposes and in the manner hereinafter appearing; It is hereby enacted in the Twenty-fifth Year of the Republic of India, by the Legislature of West Bengal, as follows :-

1. This Act may be called the Hooghly River Bridge (Amendment) Act, 1974.

2. In the Hooghly River Bridge Act, 1969 (hereinafter referred to as the said Act), for section 24, the following section shall be, and shall be deemed always to have been substituted, namely:— "Compulsory 24. Any land, with or without structures thereon, acquisition or required by the Commissioners for carrying out their requisition and acquisition of functions under this Act may be acquired under the I of 1894. land. provisions of the Land Acquisition Act, 1894, or may be requisitioned and acquired under the provisions of the West Bengal Land (Requisition and Acquisition) Act, 1948, and any such acquisition or requisition and acquisition shall be deemed to be made for a "public purpose" within the meaning of clause (fl of section 3 of the Land Acquisition Act, 1894, or for a public purpose referred to in sub-section (1) of section 3 of the West Bengal Land (Requisition and Acquisition) Act, 1948, as the case may be.".

3. After section 24 of the said Act, the following section shall be inserted, namely :— "Bar to jurisdic- 24A. No acquisition under the provisions of the Land tion of court. Acquisition Act, 1894 or requisition or acquisition or requisition and acquisition under the provisions of the West Bengal Land (Requisition and Acquisition) Act, 1948, of any land required by West Ben. (Section 4.) the Commissioners for carrying out their functions under this Act, shall be called in question in any court of law.".

4. (1) The Hooghly River Bridge (Amendment) Ordinance, 1973, is hereby repealed.

(2) Anything done or any action taken under the said Act as amended by the Hooghly River Bridge (Amendment) Ordinance, 1973, shall be deemed to have been validly done or taken under the said Act as amended by this Act as if this Act had commenced on the 31st .day of December, 1973.
