THE WEST BENGAL GRAMDAN (AMENDMENT)

ACT, 1965.

[Passed by the West Bengal Legislature.] [Assent of the Governor was first published in the Calcutta Gazette, Extraordinary, of the 16th December, 1965.] [16th December, 1965.] An Act to amend the West Bengal Gramdan Act, 1964.

WHEREAS it is expedient to amend the West Bengal Grandam Act, 1964, for the purposes and in the manner hereinafter appearing;

It is hereby enacted in the Sixteenth Year of the Republic of India; by the Legislature of West Bengal, as follows :-

1. This Act may be called the West Bengal Gramdan (Amendment) Act, 1965.

2. In the proviso to sub-section (1) of section 5 of the West Bengal Gramdan, Act, 1964 (hereinafter referred to as the said Act), for the words "no part of a village", the words "no village or part of a village" shall be substituted.

3. In sub-section (2) of section 17 of the said Act, for the words "such landless persons residing in the gramdan village ,as it thinks fit", the words "any landless person or persons residing in the gramdan village, including any group of such persons who form a co-operative society regis- tered under the provisions of the Bengal Co-operative Societies Act, 1940, with the object of cultivating such land" shall be substituted.

4. To clause (b) of section 18 of the said Act, following proviso shall be added, namely :— the AMend- meat of section. 18.

"Provided that the allottee may hypothecate such interest with the consent of the Gram Parishad in.

favour of the State iGovernment or any co-opera- tive society registered under the Bengal Co- operative Societies Act, 1940, for securing any loan advanced by the State Government or such co-operative society, as the case may be.".

5. After section 30 of the said Act, the following sec- tion shall be inserted, namely :— 30A. (1) A Gram Parishacl may apply in the prescribed manner for registration as a co- operative society under the Bengal Co-operative Societies Act, 1940.

(2) Upon such registration the provisions of the Bengal Co-operative Societies Act, 1940, shall apply to a Gram Parishacl with such exceptions, adapta- tions and modifications as the State Government may, by notification in the Official Gazette, specify.".
