Preamble

THE INDIAN STAMP ACT, 1899

ACT NO. 2 OF 18991

[27th January, 1899.] An Act to Consolidate and amend the law relating to Stamps.

WHEREAS it is expedient to consolidate and amend the law relating to Stamps. It is hereby enacted as follows:--

What this Act covers

Summary of Indian Stamp Act, 1899

Objective of the Act

The primary objectives of the Indian Stamp Act, 1899 are twofold:

1. Revenue Generation: To generate revenue for the Central and State Governments through the taxation of transactions recorded in documents.

2. Legal Validity & Evidentiary Value: To impart legal sanction to an instrument. A properly stamped document is considered valid and is admissible as evidence in a court of law.

Key Provisions

1. Definition of "Instrument"

The Act defines an "instrument" as any document by which any right or liability is, or purports to be, created, transferred, limited, extended, extinguished, or recorded. Only the instrument is taxed, not the transaction itself.

2. Chargeability of Stamp Duty

Section 3 of the Act specifies that instruments mentioned in Schedule I (such as Conveyance deeds, Promissory Notes, Bills of Exchange, Lease agreements, etc.) are chargeable with stamp duty. State governments have the power to amend Schedule I, leading to varying stamp duty rates across different states.

3. Types of Stamp Duty

• Ad Valorem Duty: Calculated as a percentage of the value of the transaction or the property mentioned in the instrument (e.g., Sale Deed, Mortgage).

• Fixed Duty: A flat rate charged regardless of the transaction value (e.g., Affidavits, Receipts, Adoption Deeds).

4. Timing of Stamping

• Executed in India: Instruments must be stamped before or at the time of execution (signing).

• Executed outside India: Instruments executed out of India (except bills of exchange or promissory notes) must be stamped within three months after they are first received in India.

5. Cancellation of Adhesive Stamps

To prevent reuse, the Act mandates that anyone affixing an adhesive stamp to an instrument must cancel it (usually by signing across it or stamping over it). If a stamp is not canceled, the document is legally treated as "unstamped."

6. Consequences of Inadequate or Non-Stamping

• Inadmissibility as Evidence: An unstamped or inadequately stamped instrument cannot be admitted as evidence in civil courts or acted upon by any public authority.

• Impounding: Public officers (except police officers) are authorized to impound (confiscate) improperly stamped documents produced before them.

• Penalties: The defect can often be cured by paying the deficit duty along with a penalty, which can be up to ten times the amount of the deficient duty.

7. Adjudication as to Proper Stamp

If there is doubt about how much duty an instrument requires, a person can apply to the Collector (Section 31) for adjudication. The Collector determines the exact duty payable, providing a certificate that protects the document from future disputes regarding its stamping.

8. Allowances for Spoiled Stamps

The Act provides a mechanism to claim a refund or allowance for stamps that were accidentally spoiled, rendered useless, or not required, provided the application is made within the prescribed time limit (usually six months).
