(7) This Act may be called the Talcher Munici- Short title pality ( Validation ) Act, 1976. and commeu- cement, BE it enacted by the Legislature of the State of Orissa in the Twenty-seventh Year of the Republic of India, as follows :- un WTO 0 g (2) It shall be deemed to have come into force on the 3rd day of June, 1976. Notwithstanding anything contained in the Validation of actions taken Orissa Municipal Act, 1950 or in any judgment, by the decree or order of any Court, all actions taken and orders passed by -- Talcher Municipal Council and Its Chairman.
(a) the Municipal Council of the Talcher Municipality in the district of Dhenkanal and by its Chairman during the period from the 12th March 1969 to the 5th February 1972 ( both the days inclusive ); and (b) the Subdivisional Officer, Talcher during the period from the 6th February 1972 to the 20th February 1975 ( both the days inclusive ) on being appointed to exercise the powers and perform the functions of the said Municipal Council and its Chairman, *For Statement of Objects and Reasons see Orissa Gazette, Extra" ordinary, dated the 29th September, 1976 ( No. 556 ). 864 THE TALCHER MUNICIPALITY (VALIDATION) ACT, 1976 [Or. Act 45 of 19761 ( Sec. 3) in the belief or purported belief that the Talcher Municipality was validly constituted, shall, for all intents and purposes, be deemed to have been validly taken and passed, and no such action or order shall be questioned in any court of law or otherwise open to challenge merely on the ground that the said Municipality was not validly constituted.
Repeal and savings. 3. (7) The Talcher Municipality ( Validation ) Orissa Ordi- Ordinance, 1976 is hereby repealed. panec No. 1 of 1976. (2) Notwithstanding such repeal anything done or any action taken under the said Ordinance shall be deemed to have been done ot taken under this Act. IndiaCol
