    Court's Decision & Legal Precedent

Writ maintainable against SBB notices where no s.24(2) prohibitory order yet exists (NGT s.52A inapplicable); even without State-prescribed Form under s.63/24(1), Indian entities must still give prior intimation under s.7 for biological resources obtained within the State; SBB cannot compel disclosure of out-of-State procurements; subject to in-State disclosure within four weeks, no s.55(2) prosecution for non-supply of the impugned notices.

On this section: Section 24(1)/(2) power of State Biodiversity Board to receive prior intimation and to prohibit/restrict activities — Court held notices alone (absent a s.24(2) order) keep High Court jurisdiction and clarified Form/intimation duties under the s.24 scheme.
