Centre for Public Interest Litigation vs Union of India
Court's Decision & Legal Precedent
The Court held that Section 11 requires one National Plan for the whole country covering all forms of disaster, and that because the National Disaster Management Plan notified in November 2019 already deals with biological and public health emergencies, and is supplemented by containment plans, guidelines and SOPs issued by the National Executive Committee and the nodal Ministry, the Union of India is not obliged to prepare, notify and implement a fresh National Plan specifically for COVID-19.
On this section: It decides, as its first formulated question, the scope of the Union's obligation under Section 11 and holds a disaster-specific National Plan is not required where the existing Plan covers that class of disaster.
