    Court's Decision & Legal Precedent

Where a party entitled to recover amounts due under s.17 has not invoked the Facilitation Council under s.18, the MSMED scheme does not oust the Court’s power to appoint an arbitrator under Arbitration Act s.11; s.18’s ‘may’ is enabling, not a mandatory exclusive path until the Council is seized.

On this section: Limits s.24’s override to the post-reference Council track, preventing an unused MSMED option from nullifying ordinary arbitration jurisdiction.

    High Court 01 Aug 2023 Persuasive (High Court Single Bench) CWP-12338-2019 & batch — Final Order 01.08.2023 (P&H HC — Vinod S. Bhardwaj J.) 2023:PHHC:105592

    Court's Decision & Legal Precedent

Section 19’s deposit-gated setting-aside remedy presupposes an award of the Facilitation Council; ‘awards’ passed solely by empaneled facilitators without Council imprimatur are void and may be corrected in writ jurisdiction, while a valid Council award remains challengeable only via s.19 with 75% deposit.

On this section: Uses s.24’s override to invalidate Council practice that would graft ad-hoc private arbitration onto the MSMED scheme contrary to the Act’s institutional design.
