[16th September, 1985.] An Act to consolidate and amend the law relating to narcotic drugs, to make stringent provisions for the control and regulation of operations relating to narcotic drugs and psychotropic substances 1[, to provide for the forfeiture of property derived from, or used in, illicit traffic in narcotic drugs and psychotropic substances, to implement the provisions of the International Conventions on Narcotic Drugs and Psychotropic Substances] and for matters connected therewith.

What this Act covers

Summary of The Narcotic Drugs and Psychotropic Substances Act, 1985

Overview

• The Act harmonizes the regulation, control, and prohibition of narcotic drugs and psychotropic substances in India, ensuring consistency between central and state government oversight. Ensures that any restrictions or punishments imposed under this Act for the cultivation of cannabis, consumption of, or traffic in, any narcotic drug or psychotropic substance within India are not less stringent than those for corresponding offenses, reflecting a unified approach to drug regulation.

Key Provisions

1. Unified Enforcement Framework: - Sections 82 & 83: While repealing predecessor acts and providing for the resolution of implementation difficulties, these sections underscore the Act's role in standardizing regulatory practices across the country.

2. Integrated Legislation with Enhanced Consistency: - Sections 79, 80, & 81: These ensure seamless integration with the Customs Act, 1962, the Drugs and Cosmetics Act, 1940, and the validation of stricter state laws, all aligned with the principle of not imposing less stringent measures than those for comparable offenses under this Act.

3. State Government's Aligned Rule-Making Power (Section 78):

• Empowers States to make rules that are consistent with the central framework, for supply of substances for medical necessity and management of treatment centres, avoiding discrepancies.

Substance Regulation and Scheduling with Penalty Alignment

• The Schedule & General Provisions: Together, they list and regulate specific psychotropic substances and all narcotic drugs, with controls on cultivation, manufacture, possession, and trade, where penalties for violations are calibrated to ensure they are not less severe than those for analogous offenses under the Act.

Penalties and Judicial Aspects with Enhanced Uniformity

• Penal Provisions: Imposing uniform and stringent penalties across the board for violations, including external dealings and repeated offenses, to maintain national regulatory coherence.

• Judicial and Procedural Measures: Establishment of special courts and standardized procedures for seized substance disposal, reflecting a consistent judicial approach.
