DATE VERIFIED Final Order 2020-10-07 (order-1.pdf; body 'WEDNESDAY, THE 07TH DAY OF OCTOBER 2020' matches index): Common judgment disposing OP(C) 3072/2019 (Joseph) and OP(C) 3280/2019 (Dennison). Trial court ordered auction sale of partition-suit property among only two sharers and confirmed sale. Held: (1) Partition Act sale on request requires a proper s.2 application from a moiety-or-upwards shareholder; (2) s.3 leave-to-buy applications are premature/incompetent without a live s.2 sale request; (3) sale via inherent power (CPC s.151) — not merely Rule 234 procedure — needs a recorded finding that division by metes and bounds is inequitable/impracticable; (4) auction confined to two sharers excluding others, and without that finding, is incompetent and void. Exhibits P15/P16 orders and consequential auction set aside; FDA to be reheard as per law. OP(C) 3072 allowed; companion petition disposed.
