    Court's Decision & Legal Precedent

Recognition of a Rubber Producers’ Society by the Rubber Board and nomination of a Board officer to the society’s executive committee to monitor Board schemes does not enlarge the Board’s s.8 functions into a power to enquire into or control the society’s internal elections or day-to-day management. A member’s Article 226 petition seeking a Board enquiry into alleged bye-law breaches and overdue elections fails where no enactment or bye-law confers such coercive supervisory power on the Board; the society remains governed by the Societies Registration Act and its own bye-laws.
