NOTIFICATION

New Delhi, the 26th August, 2010 S.O. 208t(E).-Whereas, Lindane has been identified as a highly hazardous insecticide being a persistent organic pollutant;.and 2 THE CAZETTE OF INDIA : EXTRAORDINARY lPaar II-Sec. 3(ii)l Whereas the Registration Commimee constituted under Section 5 of the lnsecticides Act l96E (46 of l96E) has recommended phasing out import, manufacture and use of Lindane in the country; and, Whereas the Cenral Govemment has considered the recommendation made by the Registration Committee; and, Therefore, in exercise ofthe power confened by suts section (2) ofSection 27 read with Section 28 ofthe said Acl, the Cenlral Government proposes to make the following order, namelv :- 'Draft Order' l. (l) This order may be called the Banning of I-indane Order,20l0.

(2) lt shall come into force on the date of final publication ofthis Order in the Official Gazette.

2. No person shall manufactirre, import or formulate Lindane ftom thc date oltinal publication of this order in the Ot'Iicial Cazene .

3. No person shall use Lindane after the period of two years liom the date offinal publication ofthis Order in the Omcial Cazefte .

4. The certificate ofregistration for Lindane granted uoder the Section 9 ofthe said Act shall be deemed to be cancelled.

5. Every State Government shall take all such steps under the provisions ofthe said Act and the rules fi'amed thereunder, as it considers necessary for the execution of this order in the state.

The draft order, which the Central Governmenr proposes to make, is hereby published for imformation of allpenons likely to be affected thereby and noticc is hereby given that the said draft order shall be taken into consideration after the expiry ofa period of forq-five days from the date on which the copies ofthe Gazette of India containing this Order are made available to the public.

Any suggestion or objection in respect ofthis draft order may be forwarded to the Central Govemment so zts to reach within the period specified to the Joint Secretary (Plant Protection), Ministry of Agricuhure, Depaxtment of Agriculture and Cooperation, Krishi Bhavan, New Delhi- I 10001 .
