Court's Decision & Legal Precedent
DATE-VERIFIED Final Order 2007-09-17 (order-1.pdf; body date 17th September 2007 matches index): SDF Act s.4(1)(bb) funds buffer-stock maintenance; technical breach of SDF Rules r.19(10) prior-permission for buffer replacement (where Excise certificates show stock was maintained/replaced under perishability exigency) does not justify denying buffer subsidy — purposive reading of Act objects and flexible Rule provisos; remittal to reconsider within 3 months.
On this section: s.4 Application of Fund for building/maintaining buffer sugar stocks guides subsidy decisions — technical Rule 19(10) breaches cannot defeat the Fund purpose where buffer was in fact maintained.
