-
Fakruddin vs State
Decided under Code of Criminal Procedure 422, which this section replaces. The court did not have this Act before it.
Court's Decision & Legal Precedent
Compensation awarded under Section 5 of the Probation of Offenders Act, 1958 must be recovered as a fine in accordance with the provisions of Sections 421 and 422 of the Criminal Procedure Code, 1973, through attachment and sale of movable property or realization as arrears of land revenue. Imprisonment cannot be imposed as a default punishment for non-payment of such compensation, as such an order would be patently illegal and contrary to the statutory provisions. Additionally, the quantum of compensation must be reasonable and proportionate to the nature and gravity of the offence, and courts have discretion to reduce excessive compensation amounts in the interest of justice.
On this section: Recovery of fine by warrant to Collector for realization as arrears of land revenue; alternative mechanism for compensation recovery

Kuruva Maddileti vs The Superintendent of Police
Decided under Code of Criminal Procedure 422, which this section replaces. The court did not have this Act before it.
Court's Decision & Legal Precedent
When a party seeks High Court intervention in criminal proceedings through writ jurisdiction, and adequate alternative remedies exist before the subordinate court (such as discharge applications or Section 422 Cr.P.C. petitions for quashing), the High Court may permit withdrawal of the writ petition with liberty to pursue such alternative remedies, recognizing that statutory procedures provide the appropriate forum for addressing grievances in criminal matters.
On this section: Cited as an alternative remedy available to petitioners for quashing of criminal proceedings, suggesting that Section 422 Cr.P.C. provides a statutory mechanism for challenging criminal proceedings before the Magistrate Court itself
