Alstom Transport India Limited v. Commissioner of Commercial Taxes
Court's Decision & Legal Precedent
Labelled Final Order 15.07.2025 (order-1.pdf; body dated 15th July 2025 — DATE-VERIFIED despite cache warning): Karnataka HC quashed IGST demands on secondment/manpower supply. Applying CBIC Circular 210/4/2024-GST para 3.7 and Metal One (Delhi HC), where related-party services attract full ITC and no invoice is raised, open-market value under Rule 28/second proviso may be deemed Nil for s.15(4) valuation; secondment on these facts also fell within Schedule III employer-employee exclusion. Demands of ~₹57.95 crore set aside.
On this section: Direct teaching on s.15(4) valuation of related-party/cross-border secondment supplies and Nil OMV deeming where no invoice exists and full ITC is available.
