Court's Decision & Legal Precedent
In cases where an accused is not named in the FIR but implicated only through a co-accused's confessional statement, and where no incriminating material is recovered from the accused's possession, the absence of direct evidence and corroborating material constitutes sufficient grounds for granting bail during trial, provided stringent conditions are imposed to ensure court attendance and prevent witness intimidation or evidence tampering.
