Court's Decision & Legal Precedent
DATE VERIFIED Judgement 2020-03-05 (order-102.pdf) — index and body agree (March 05, 2020). Pharmacy Act is a special law for pharmacy education. Under s.12, only PCI (Central Council) may approve a State authority's course of study / examination for pharmacists; AICTE intake/approval cannot override PCI refusal. Norms fixed by PCI under the Pharmacy Act must be followed for pharmacy degrees/diplomas.
On this section: s.12 — PCI approval of pharmacy courses of study and examinations is exclusive; AICTE cannot authorise pharmacy courses contrary to PCI.
