Kizhakkekkara Rubber Traders v. Rubber Board & Ors.
Court's Decision & Legal Precedent
Sale of rubber to an unlicensed manufacturer is a licence-condition violation under the Rubber Act licensing scheme (s.14). The Board may proceed against the licencee after notice, but must also proceed against the unlicensed manufacturer rather than treating licence-suspension of the trader as the only sanction; cess liability is to be finally adjudicated after hearing both the seller and the unlicensed purchaser, with any interim deposit adjusted.
