G. Sakthivel v. Union of India
Court's Decision & Legal Precedent
Even where a recruitment ban defeats individual claims for absorption, Apprentices Act s.22(1) still obliges every employer to formulate its own policy for recruiting apprentices who complete training; absence of such a policy is statutory non-compliance and the High Court may mandamus the Port Trust to frame a s.22 policy within a fixed time while declining to quash a ban-based rejection.

Shiwang Tripathi v. Union of India
Court's Decision & Legal Precedent
Apprentices Act s.22(1) lets the employer formulate absorption policy and creates no general right to regularisation; s.22(2) binds the employer to offer employment only where the apprenticeship contract itself obliges the apprentice to serve after training. Where advertisement and appointment letter expressly say absorption is not obligatory and impose no reciprocal post-training service condition, accounts apprentices cannot compel absorption under s.22(2).
